Limits on Parent's Authority

Unless the parents agree differently in child custody negotiations, the parent with whom the child resides may determine the child's upbringing. The custodial parent has the authority to determine education, health care, and religious training. The court can always interfere if it believes that the child's physical or emotional health is in danger or that the child's emotional development is impaired.

Court Order

The court may order the local social services agency or the department of court services to continuing to supervise the case under guidelines established by the court to assure that the custodial or parenting time terms of the decree are carried out. Supervision by the court or by social services can add a significant amount of stress to divorce proceedings.
