Temporary Support & Maintenance

Quick Facts
  • Temporary support or maintenance can help a dependent spouse get through the divorce and custody proceedings.

The court may award temporary spousal maintenance and temporary child support. The court may also award to either spouse the right to the exclusive use of the household goods and furniture of the spouses and the right to the use of the homestead, exclusive or otherwise, pending the proceeding. The court may order either spouse to vacate the homestead after proper application to the court for such an order.

Temporary child support and maintenance may be ordered during the time a parenting plan is being developed.

Temporary support is commonly necessary when the spouse or parent in need is facing financial hardship because that person has been a stay-at-home parent while the other was working.
