The irretrievable breakdown of a marriage occurs when one spouse refuses to live with the other and refuses to work toward resolution of the differences between the spouses. The irretrievable breakdown is the grounds for no-fault divorce in Minnesota. If both spouses agree that the marriage is irretrievably broken, or one of the spouses makes that allegation and the other has not denied it, the court, after hearing, will determine that the marriage is irretrievably broken.

Disputes over Irretrievable Breakdown

If the respondent spouse (the one who was served with the divorce papers) disputes that the marriage has suffered an irretrievable breakdown, then a court will make a determination about whether or not the marriage has suffered an irretrievable breakdown.
