After being summoned for divorce proceedings in Minnesota family court, the spouses must take care not to violate certain restraints that Minnesota divorce law places on them.
In general, neither spouse may dispose of any assets. There are exceptions, for the necessities of life, for the necessary generation of income, or for the preservation of assets; by an agreement in writing; or for retaining counsel to carry on or to contest the divorce proceeding. Neither spouse is permitted to harass the other spouse! This is important. Harassing your spouse can result in severe consequences. I know you may be mad. Call me if you feel your anger getting the better of you.
Insurance coverage must be maintained and continued without change in coverage or beneficiary designation. Either spouse who holds coverage for the other or for the children must maintain coverage. Except, if the insurance holder is terminated from his or her job, then the coverage obligation may lapse. Still, call me right away if this happens.
You are bound to the restraining provisions contained in the notice by operation of law until modified by further order of the court or dismissal of the proceeding, unless more than one year has passed since the last document was filed with the court. You are bound from the time the notice is served on you, whether you agree to the restrictions or not.
If you violate any of these provisions, you may be subject to sanctions by the court. You are better off complying. It is important to deal with any problems using the legal means available through the courts.
