Uncontested Divorce in Minnesota

Quick Facts
  • If you can agree on your divorce, then you can save money, time, and stress.
  • $780 attorney fee for divorce.
  • $250 attorney fee for review.
  • Uncontested divorce will take on average 6 to 9 weeks.

If you and your spouse agree on each and every part of getting divorced, then you may obtain a divorce by filing a joint petition for dissolution with the court.

Mutual agreement to divorce saves money, for certain, but even more importantly an agreement can also save a lot of mental and emotional strain.

Cost: My fee is currently $780.00 to prepare the uncontested divorce papers. The filing fee is additional, paid by the petitioners, and depends on the county of filing. There may also be additional fees, such as the cost of a certified copy. You can find filing fees for Hennepin County and Ramsey County.

Timeline: From the date our services are hired, you can expect the paperwork to be prepared within two to three weeks, assuming the required information is submitted promptly. Approximately four to six weeks after the paperwork is filed with the court, the judge will enter the judgment and decree of dissolution, and the court clerk will mail notice of the final decision to the attorney, who will deliver copies to you.

Self-help: Should you choose to complete the paperwork yourself, which you certainly have the option to do, then you can and should still have an attorney review the documents for you. I offer this review for $250.00, which includes written recommendations and unlimited phone consultation to answer questions. The review can be done and recommendations delivered in as little as one week.

Contested Divorce

If you and your spouse cannot agree on each and every issue, then you cannot file a joint petition as an uncontested divorce. In a contested case, you will have to follow the standard contested divorce procedures.
